The terms on which we share PrimeHarbor's editorial content with you — and the responsibilities that come with using the water.

1. Acceptance of these terms

These Terms & Conditions govern your access to and use of primeharborvie.com (the "site") operated by PrimeHarbor ("we", "us", "our"). By accessing or using the site, you agree to be bound by these terms. If you do not agree, please do not use the site.

2. About the service

PrimeHarbor is an independent Australian editorial website. We publish general educational content about recreational fishing, boating, tides, species, gear and coastal recreation. We are not a retailer, a charter or booking service, a training provider, or a government or regulatory body. We provide information only.

3. Important safety disclaimer

Read before you head out

Our content is general in nature and is not a substitute for official marine forecasts, navigation charts, safety training, fishing licences or current regulations. Conditions on the water change quickly and vary by location.

Before any trip, you must verify conditions and rules with the Bureau of Meteorology and your state or territory maritime and fisheries authority. You are responsible for your own safety and for the safety of those with you, including carrying the correct safety equipment and holding any required licences.

4. Assumption of risk

Fishing, boating and other outdoor and water-based activities involve inherent risks, including changing weather, currents, tides, equipment failure and physical hazards. You acknowledge and accept these risks. Any decision to undertake an activity based on information from this site is made at your own risk and on your own judgement.

5. No warranties

We work hard to keep our content accurate and current, but we make no representations or warranties that information on the site is complete, accurate, reliable or up to date. The site is provided on an "as is" and "as available" basis. To the extent permitted by law, we exclude all implied warranties.

6. Limitation of liability

To the maximum extent permitted by law, PrimeHarbor will not be liable for any loss, damage, injury or cost arising from your use of, or reliance on, the site or its content, whether direct, indirect, incidental or consequential.

Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to the resupply of the relevant content.

7. Intellectual property

All content on the site — including text, graphics, illustrations, logos and layout — is owned by PrimeHarbor or its licensors and is protected by copyright and other intellectual property laws. You may view and share content for personal, non-commercial use with attribution. You must not reproduce, republish or commercially exploit our content without our written permission.

8. User submissions

If you send us feedback, suggestions, photos or other material (for example, by email or contact form), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and adapt that material in connection with PrimeHarbor. You confirm that you own or have the right to share what you send, and that it does not infringe anyone else's rights.

10. Acceptable use

When using the site, you agree not to:

  • use it for any unlawful purpose or in breach of these terms;
  • attempt to gain unauthorised access to the site or its systems;
  • interfere with the site's operation or security; or
  • copy, scrape or redistribute our content in breach of section 7.

11. Governing law

These terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

12. Changes to these terms

We may update these terms from time to time. The "Last updated" date shows when they were last revised. Your continued use of the site after any change means you accept the updated terms.
